Trademark registration in Dubai is an important part of business setup in Dubai or UAE. But
what is a trademark in Dubai law?
Dubai trademark office states “a
trademark, trademark or a trade-mark is
a sign or indicator used by an individual, business, organization, or other
legal entity to identify that the products or services to consumers with which
the trademark appears originate from a unique source, and to distinguish its
products or services from those of other entities.
A Trademark Registration in UAE could be a name, word, phrase,
design, image or a combination of these elements. It could also be a physical
attribute of an object like its color, smell or sound.
A legal identity can commence legal proceedings
again any individual or business, in case the said identity finds an instance
of copyright infringement.
Step 1: fill up the name reservation form
on the DED website and pay the requisite fee.
Step 2: the application will be
queued for approval of the trademark office and a trademark will be issued. (it is not a step
as such)
Step 3: approved applications are
needed to be published in trademark journal and two local Arabic newspaper. There
is a 30 day period, in which a legal identity can oppose the trademark
approval of a competent court.
Step 4: if the approval is unopposed
then the trademark is registered and
certificate of registration is issued.
Register a trade name and obtain a
business license from the Department of Development (DED). To register a trade
name, visit the DED website and complete the name reservation application, and
wait for a letter of approval. The cost to reserve a name is AED 200 (USD
$54.45).
